GENERAL TERMS AND CONDITIONS OF SALE (GTC)

These General Terms and Conditions of Sale govern the purchase of products offered through the website www.bottegandoitalia.it (the "Site") by consumers and professionals.
Placing an order implies full acceptance of these terms and conditions.

The Seller is responsible for order management, delivery, and after-sales service.
2. Scope of the Contract
2.1. These GTC govern the sale of products through the Site.
2.2. The contract is deemed concluded upon the Seller's sending of the order confirmation by email.
2.3. The products are described in the relevant technical data sheets, complete with the mandatory information required by the Consumer Code and the applicable EU Regulation.
3. Prices and Availability
3.1. Prices listed on the Site are in euros and include VAT, unless otherwise indicated.
3.2. Shipping costs, if applicable, are indicated before the order is finalized.
3.3. Product availability is updated regularly; however, in the event of subsequent unavailability, the Seller will provide a full refund of the amount paid.
4. Orders
4.1. The user can select the products, add them to the cart, and proceed with the order by following the instructions on the Site.
4.2. Before submitting the order, the user can check and correct any errors in the data entered.
4.3. Once the order is complete, the Customer will receive an order confirmation containing:

Total price
Shipping costs
Customer information
Payment methods
Link to these GTC on a durable medium
4.4. The Seller reserves the right to cancel orders that are irregular, fraudulent, or do not comply with internal policies.
5. Payment Methods
5.1. Payments can be made using the methods indicated on the Site (e.g., credit card, PayPal, bank transfer, digital payment).
5.2. Payment is in advance and is an essential requirement for product shipment.
5.3. Payment data is processed using secure systems in accordance with European PCI-DSS regulations.
6. Shipping and Delivery
6.1. The Seller delivers via qualified couriers.
6.2. The delivery times indicated on the Site are estimates and not binding.
6.3. Products will be delivered within a maximum of 30 days from order confirmation, unless otherwise agreed.
6.4. Upon delivery, the risk of loss or damage passes to the Customer.
6.5. In the event of obvious damage to the packaging, the Customer must immediately report it to the courier and the Seller.
7. Right of Withdrawal (consumers only)
7.1. Pursuant to Legislative Decree 206/2005 (Consumer Code), the Consumer Customer may withdraw from the contract within 14 days of receiving the goods, without having to provide a reason.
7.2. To exercise the right of withdrawal, the Customer must send written notification to:

7.3. The Customer must return the products within 14 days of notification of withdrawal, paying shipping costs, unless otherwise agreed.
7.4. The products must be returned intact, unused, and complete with their original packaging.
7.5. The Seller will refund the amount within 14 days of receiving the goods or proof of shipment, using the same payment method.
7.6. The right of withdrawal does not apply in the cases provided for by Article 59 of the Consumer Code (e.g., personalized, perishable, or sealed goods that are non-returnable for hygiene reasons).
8. Legal Guarantee of Conformity
8.1. The products are covered by the legal guarantee of conformity provided for by Articles 128–135 of the Consumer Code.
8.2. The duration of the guarantee is:
24 months for consumer customers
12 months for professionals (B2B)
8.3. In the event of a defect, the Customer may request free repair, replacement, price reduction, or termination of the contract, within the limits of the law.
8.4. It is the Customer's responsibility to report the defect within 2 months of discovery.
9. Limitation of Liability
9.1. The Seller shall not be liable for indirect damages, loss of profits, or disruptions resulting from causes beyond its control.
9.2. The Seller does not guarantee the absence of Site interruptions, although it undertakes to maintain an adequate level of security.
10. Force Majeure
The Seller shall not be liable for non-performance resulting from events beyond its control (e.g., natural disasters, transport disruptions, strikes, health emergencies, cyber attacks).
